Terms of Service

1. Acceptance of Terms

By accessing and using Dexcy SaaS ("the Service"), provided by Dexcy Technologies Pvt. Ltd. ("Dexcy", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Dexcy governing your use of the Service.

If you do not agree to these Terms, you may not access or use the Service. By continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms.

2. Description of Service

Dexcy SaaS is a cloud-based website content management system ("CMS") platform that enables agencies and developers to create, publish, and manage websites and content without writing code.

Dexcy reserves the right to modify, suspend, or discontinue the Service (or any portion thereof) at any time, with or without notice. We may also modify features, functionality, or pricing at our sole discretion. We will provide reasonable notice of material changes that adversely affect your use of the Service.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the accuracy of your account information
• Keep your password confidential and secure
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use
• Not share your account with others

One account per person or business entity is permitted. You are responsible for maintaining the security of your account credentials and are liable for any actions taken under your account.

4. Acceptable Use

You agree not to use the Service for any illegal, abusive, or harmful purposes. You specifically agree not to:

• Publish illegal, defamatory, obscene, or offensive content
• Engage in spam, phishing, or fraudulent activities
• Reverse engineer, decompile, or attempt to access the source code
• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt the Service or servers
• Resell, redistribute, or commercialize the Service without permission
• Violate any applicable laws or regulations

Violation of these terms may result in immediate suspension or termination of your account without refund.

5. Payment & Billing

Subscription fees are billed monthly in Indian Rupees (INR) unless you choose an annual plan. All prices displayed include applicable Goods and Services Tax (GST). Payment is processed securely through Razorpay.

By providing payment information, you authorize us to charge your chosen payment method for the subscription fee. Billing occurs on the same day each month or year, depending on your selected plan. Subscriptions automatically renew unless cancelled.

Refunds are provided according to our Refund Policy. Failed payments may result in suspension of your account. If payment fails, we will attempt recharge on subsequent days before account suspension.

6. Intellectual Property

The Service, including its code, design, structure, and features, is owned by Dexcy and is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes.

Content you create and publish through the Service remains your property. You grant Dexcy a non-exclusive license to host, display, and process your content for the purpose of providing the Service.

You may not copy, modify, distribute, or sell the Service or its components without express written permission from Dexcy.

7. Termination

Dexcy may suspend or terminate your account immediately for violation of these Terms, illegal activity, or misuse of the Service. Termination may result in loss of access to your account and content without refund of paid fees.

You may cancel your subscription at any time from your account Settings → Billing section. Cancellation takes effect at the end of your current billing cycle. You will not be charged for the next billing period after cancellation.

8. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Dexcy makes no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Dexcy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, even if advised of the possibility of such damages.

Our total liability to you for any cause of action arising from these Terms or your use of the Service shall not exceed the amount paid by you for subscription fees in the 3 months preceding the claim.

9. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

Any legal action or proceeding relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

10. Changes to Terms

Dexcy may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
